General terms of sale

1. Purpose

The purpose of these General Terms of Sale (the “TOS”) is to establish the legal framework, as well as the respective rights and duties of the parties identified below, applicable to all mail-order purchases made by email, mail, or via the online store available at www.bosabo.com.

The TOS exclusively apply between:

STE AUDOUIN (hereinafter “Audouin Bosabo”)

any natural person, excluding any business customers, visiting or placing an order via the website www.bosabo.com, property of Audouin Bosabo, or ordering by mail or email (hereinafter the “User”).

The User represents and warrants that he or she has the legal capacity to place an order and use the chosen payment method.

The User can consult the TOS at any time by clicking the link “General Terms of Sale” in the footer of the website www.bosabo.com (hereinafter the “Site”).

Accordingly, Audouin Bosabo encourages all Users to read the TOS. Audouin Bosabo would also like to note that the User is not entitled to purchase any products sold on the Site without first accepting the TOS.

The TOS are subject to modification. The applicable version is the one in force on the date on which the User places their order on the Site or by telephone, email, or mail.

2. Products and availability

The availability of the shoes presented on the Site is dependent on the production capacity of the Audouin Bosabo workshop. There is no permanent inventory in stock, and production for every pair ordered begins once payment has been approved. The average wait time for a pair to be produced is 1 to 2 weeks, depending on the current workload of our workshop. This time may be longer during vacation periods.

The average 1- to 2-week production time stated in the TOS is not a firm engagement on the part of Audouin Bosabo. However, if the total production time exceeds thirty days from the date on which payment for the order has been approved, the buyer may choose to cancel the order in exchange for a full refund, without being owed any additional compensation.

The order is not final until a confirmation email has been sent from contact@bosabo.com

The products presented are photographed and described as faithfully as possible.

Important: Depending on the web browser and/or screen used, the colors seen online may not perfectly reflect those in real life.

3. Orders

To purchase a product on the Site’s online store, the User must:

  1. Create a customer account and fill in the registration form with the information requested. Login credentials will then be assigned to the User.

  2. Select one or more article(s), size(s), and color(s).

  3. Confirm the shopping cart to finalize the order.

  4. Make a payment in accordance with the requisite conditions.

Orders may also be placed without using the Site:

We undertake to produce and fulfill orders placed. However, if this is impossible, we will contact the customer to propose another article. If the parties cannot reach an agreement, the order will be canceled and fully refunded.

We reserve the right to cancel or reject any order from a customer with whom we have a dispute regarding the payment of a previous order or with regard to whom there exists a suspicion or risk of fraud.

4. Price

Prices for our articles are stated in euros (€) and include all taxes, including VAT. VAT corresponds to the Value Added Tax applicable in France at a rate of 20%. Generally speaking, VAT applies to all products paid for by Users with a permanent address. If the applicable VAT rate changes, this change may be reflected in the prices of products.

Audouin Bosabo reserves the right to change its prices at any time. Products will be invoiced to User at the going price at the time of order placement. Products remain the property of Audouin Bosabo until the price has been completely paid. The price is payable in full and in a single payment.

SHIPPING COSTS

In addition, the User may also be required to pay shipping costs.

The amount of shipping costs is fixed for all orders.
Mainland France: basic shipping included
Europe: €20
Other countries (including French overseas territories): €50
Customs Duties and Import Taxes

Orders placed on the Site and shipped outside of France or the European Union may be subject to customs duties and import taxes payable when the shipment arrives at its destination. The User assumes responsibility for and must bear the cost of all such customs duties and taxes associated with the delivery of a product.

Audouin Bosabo is not required to verify and inform the User of applicable customs duties and taxes. To learn which taxes and duties apply, Audouin Bosabo advises the User to seek information from the relevant authorities in the User’s country.

5. Shipment and delivery

Delivery times are provided for information purposes only and no warranty whatsoever is offered in this respect.

The average combined production and delivery time is ± 10 days (excluding weekends, bank holidays, and workshop closure for vacation periods).

If the User expressly asks us to do so, we may agree to shorten these production times on an exceptional basis. To learn whether this is feasible, send us an email to contact@bosabo.com.

Delivery times:
For mainland France and Corsica: shipments are delivered via Colissimo Suivi. The average delivery time is 2 to 7 business days in mainland France and Corsica.

For Europe, French overseas territories, and other countries: your delivery will be sent via La Poste Colissimo International. The average delivery time is 8 to 15 business days.

Products ordered are always shipped at the User’s own risk. The User must verify the state of the products upon receipt of the package, and the shipping company must be given notice of all issues pertaining to missing or damaged items within 48 hours at most. We also advise you to verify the state of the article(s) contained in your package upon receiving the shipment and write “without prejudice + reasons” on the shipping company’s delivery slip, or to refuse the shipment altogether and write “delivery refused because opened or damaged” on the delivery slip. In this case, the User must immediately notify Audouin Bosabo by email at contact@bosabo.com and provide a detailed explanation of the problem encountered (with photos if possible).

In the event of abnormal delivery times, the User must send an email to Audouin Bosabo to initiate a procedure with the shipping company to locate the shipment. The shipping company may take between 10 and 30 days to respond. Audouin Bosabo will keep you informed of the progress of the procedure. While the procedure is pending, the User will not be entitled to a refund and/or compensation.

Deliveries are made to the address specified on the purchase order. The following additional information is needed:
- the building access code;
- the presence of a concierge;
- any other information that might help ensure the order is properly delivered.

We cannot be held liable if, due to errors or inaccuracies in the name or address provided by the buyer, delivery of the order proves impossible.

The User will receive an automated message from Colissimo with their tracking number. With this number, the User is able to track the progress of delivery at any time on https://www.laposte.fr/outils/suivre-vos-envois

If the User is absent at the time of delivery, a failed delivery notice will be left by the driver indicating that the package is available for pickup at the local post office. The User’s package will be available for 15 days. If the User fails to retrieve it within this time, it will be returned to us.

If the package is returned to us, upon receipt, we will make every effort to contact the User and schedule another delivery via Colissimo. The User will be responsible for the cost of reshipment.

6. Payment

By credit/debit card: Visa, Mastercard, Eurocard, Carte Bleue

This service uses the SSL security protocol. All confidential payment data (16-digit card number, expiration date, etc.) is transmitted in encrypted form directly on the bank’s website. When the User finalizes their order, the payment request is routed through the secure remote payment solution PayPlug in real time.

By check (banks based in France only)

Checks must be issued by a bank based in mainland France and made out to STE AUDOUIN. They should be sent to STE AUDOUIN, 4 Rue des Amourettes, Montigné sur Moine, 49230 Sèvremoine, France.

Orders will not be processed until the check has been received. Consequently, applicable production and delivery times for orders paid by check will begin to run from the date of receipt of the check, and may not correspond to the times mentioned above. Checks must be sent within 5 business days of the date of purchase to guarantee approval of your order. We ask that you contact us if you exceed this time limit.

Checks are deposited when the order ships.

By bank transfer

When wiring funds, please specify your order number in the object field of the bank transfer and inform us as quickly as possible. Orders will not be processed until the transfer has been received.

Payment acceptance

Payment is deemed accepted upon receipt of the check for payment by check, upon receipt of any additional information requested in the event of credit/debit card payment requiring additional verification, and upon receipt of the funds in our bank account in the event of a bank transfer.

We do not accept cash, money order, or cash-on-delivery.

7. Returns

You are legally entitled to return products up to fourteen days after delivery of your order.

In accordance with the provisions of the French Consumer Code, refunds or exchanges are not available for customized or made-to-measure orders.

Products returned must be in mint condition, unused, and in their original packaging pursuant to the following conditions.

Upon receiving a return, Audouin Bosabo will judge whether the returned merchandise is in perfect condition. No returns will be accepted if the product(s) returned have been visibly used or damaged by the buyer and this use or damage renders the product(s) unsuitable for sale.

Audouin Bosabo undertakes to refund all amounts paid if the return complies with the above conditions. Refunds will be made directly onto the payment card used (or by check, where appropriate) within 14 days of receipt of the return package.

If the return does not comply with the above conditions, the product will be returned to the buyer at our expense; in this case, the buyer will not in any way be entitled to any compensation or refund.

The customer bears the cost of returning products and will not be reimbursed for shipping or other costs associated with returns. In addition, we advise you to make all returns with proof of delivery, signature required, or else we may be unable to proceed with the refund or exchange of your products.

The return package must be sent within the fourteen-day (14-day) legal time limit to the following address:

To make it easier to process your request for an exchange or refund, it is mandatory to contact us by email before returning your articles.

In your return package, please include:

- Your full mailing and contact information;
- A copy of your invoice or your online order number;
- The RETURN form we sent to you by email (with the reference(s) of the desired exchange article(s) or request for a refund).

You may select the shipping company of your choice for the return. We advise you to choose a delivery method with proof of delivery, signature required, as we cannot be held liable if your package is lost.

PLEASE NOTE: wood is a hard, sturdy natural material, but it can be damaged on impact. Damage to soles caused by impacts is not deemed to be a valid reason for replacing or refunding chipped clogs, absent a clear defect in the product.

9. Protection of personal data

Whenever the User places an order on the Site for the first time, the User is asked to create a password.

The password can be used for each new order without having to enter the User’s information again (with the exception of payment information, which is not stored from one order to the next). It also allows the User to view pending orders. To enable the order to be fulfilled, the User’s personal data must be processed, which the User explicitly accepts.

For the purpose of fulfilling the order, the User’s data may also be made available to Audouin Bosabo’s business partners.

Audouin Bosabo undertakes to protect the User’s personal data. All of the User’s personal data collected by Audouin Bosabo is processed with the highest degree of confidentiality, in strict accordance with the provisions of the French Data Protection Act (Law 78-17 of January 6, 1978).

Nevertheless, the User is entitled to access and correct their data contained in Audouin Bosabo’s systems at any time.

Notice that personal data is being collected and processed has been filed with the French Data Protection Authority (CNIL).

10. Governing law

The TOS are governed by, and shall be construed in accordance with, the laws of France and the United Nations Convention on Contracts for the International Sale of Goods.

The courts of France shall have exclusive jurisdiction over any disputes arising from or in relation to the business relationship between Audouin Bosabo and the User.

11. Dispute resolution

By placing an order, the User fully and completely accepts the terms of the TOS.

The TOS are governed by the laws of France.

If a dispute arises from or in relation to this contractual relationship, the User and Audouin Bosabo undertake, before initiating any legal action, to seek an amicable solution.

In the event of a dispute, the courts of competent jurisdiction of the Republic of France shall have exclusive jurisdiction.

12. Intellectual property

Everything contained on the Site is and shall remain the exclusive intellectual property of Audouin Bosabo.

No part of the Site (including software, written content, images, or sounds) may be used, exploited, reproduced, or disseminated in any way whatsoever, even partially, without prior consent.
